DMCA COMPLIANCE STATEMENT
In compliance with the Digital Millennium Copyright
Act (DMCA) our registered agent must receive and review any
claims submitted to 5DollarHosting.com® under this act.
The procedure for filing a claim is as follows:
1.) Our registered DMCA Agent must receive all claims of infringement.
In accordance with DMCA Section 512(c)(3)(A), the following
is required of notices alleging infringement:
ELEMENTS OF NOTIFICATION
To be effective under this subsection, a notification
of claimed infringement must be a following:
(i) A physical or electronic signature of a person authorized
to act on behalf of the owner of an exclusive right that is
allegedly infringed.
(ii) Identification of the copyrighted work claimed to have
been infringed, or, if multiple copyrighted works at a single
online site are covered by a single notification, a representative
list of such works at that site.
(iii) Identification of the material that is claimed to be
infringing or to be the subject of infringing activity and
that is to be removed or access to which is to be disabled,
and information reasonably sufficient to permit the service
provider to locate the material.
(iv) Information reasonably sufficient to permit the service
provider to contact the complaining party, such as an address,
telephone number, and, if available, an electronic mail address
at which the complaining party may be contacted.
(v) A statement that the complaining party has a good faith
belief that use of the material in the manner complained of
is not authorized by the copyright owner, its agent, or the
law.
(vi) A statement that the information in the notification
is accurate, and under penalty of perjury, that the complaining
party is authorized to act on behalf of the owner of an exclusive
right that is allegedly infringed |
2.) Our agent will review each claim within (3) business days
of receipt. If the claim does not sufficiently comply with the
Elements of Notification as listed above, our agent will make
a reasonable attempt to contact the claimant so that a properly
completed claim can be established.
3.) Upon receipt of a complete claim of infringement, our agent
will disable access to the material claimed to be infringing.
This will be accomplished within (14) days of receipt of a completed
and valid notification.
4.) Our agent will restore access to the material upon proper
compliance with the terms of DMCA regarding "Put Back"
procedures. Upon valid notification, our agent will provide restored
access within (14) days. The law requires "Put Back"
or Counter-Notification claims to contain certain information
as indicated below:
ELEMENTS OF COUNTER NOTIFICATION
To be effective under this subsection, a counter notification
must be a written communication provided to the service provider's
Registered Agent that includes substantially the following:
(i) A physical or electronic signature of the subscriber.
(ii) Identification of the material that has been removed
or to which access has been disabled and the location at which
the material appeared before it was removed or access to it
was disabled.
(iii) A statement under penalty of perjury that the subscriber
has a good faith belief that the material was removed or disabled
as a result of mistake or misidentification of the material
to be removed or disabled.
(iv) A statement that the affected party has a good faith
belief that use of the material does not infringe the rights
of the copyright owner, or its agent, or the law.
(v) The subscriber's name, address, and telephone number,
and a statement that the subscriber consents to the jurisdiction
of Federal District Court for the judicial district in which
the address is located, or if the subscriber's address is
outside of the United States, for any judicial district in
which the service provider may be found, and that the subscriber
will accept service of process from the person who provided
notification under subsection (c)(1)(C) or an agent of such
person. |
5.) 5DollarHosting.com®'s registered DMCA agent, or authorized
associate, will promptly notify our client when material in their
account must be removed or have access disabled. This notice will
include DMCA-related information in order to make a Counter Notification
and any necessary instructions pertaining to that filing.
6) Under no circumstances shall 5DollarHosting.com® be a
party to any copyright infringement disputes. Our complete and
total responsibility is limited to the actions required under
the DMCA.
